State Utility Commission Proceedings

Our attorneys advocate on behalf of our clients in complaints, rulemakings, and other proceedings before the public utility commissions of Oregon, Washington, Idaho, and California.  We regularly prepare written testimony, exhibits, pleadings, and other elements of administrative filings.  We have the expertise needed to evaluate the strength of claims and defenses and strategize an efficient path through the state administrative process while protecting our clients’ interests.

Representative Work Resulting in Published Orders or Rules

  • Achieved favorable rule before Idaho Public Utilities Commission to address whether aggregated wind and solar qualifying facilities are eligible for published rates.  (Investigation in Disaggregation Phase I and Phase II)
  • Successfully defended utility before Oregon Public Utility Commission against complaint that utility refused to purchase output from a qualifying facility (International Paper Co. v. PacifiCorp)
  • Represented utility in obtaining approval of Idaho Public Utilities Commission for amendments to power purchase agreements.  (e.g. Lower Valley)
  • Rulemaking before the Oregon Public Utility Commission regarding interconnection of generators of 10 MW or less.  (OAR Chapter 860 Division 082)
  • Rulemaking before the Oregon Public Utility Commission regarding interconnection of large generators.  (UM 1401)
  • Rulemaking before the Washington Utility and Transportation Commission on interconnection of generators of 10 MW or less.  (WAC Chapter 480-108)
  • Revision of tariff terms applicable to purchases from small qualifying facilities in Oregon.  (Investigation in Avoided Cost Purchases)
